1. Meeting Summary
I spoke with Norbert about the first-step document package tied to the TS 55 matter. He has prepared a file share with two ZIP files: one containing standard non-confidential material, and a second containing confidential materials, including presentations, documents, benchmarks, risk analysis, and the two Excel files with his comments and investigation results.
We aligned on a controlled handling approach for the confidential information. My direction was that we should not share confidential materials any more broadly than necessary and ideally only under court order or similar formal requirement. A key concern is that some of the documents include personal names and other data elements that create sensitivity under German and broader EU data protection rules. I made clear that if outside parties need guidance on what can be shared, they should confirm with qualified European counsel rather than make assumptions.
Norbert also noted that most of the material is in German. I confirmed that translation is not our responsibility under the current process. My next step is to review the files first so I can determine what should and should not be released. If the court continues to require production, I will manage follow-up discussions and coordinate any further disclosures as needed.
2. Attendee List
- Scott Warner
- Norbert Wahl
3. Action Items
- [Norbert Wahl] Send me the file-share link in a separate email for the TS 55 materials.
- [Norbert Wahl] Send a separate email with the open questions arising from review of the indictment.
- [Scott Warner] Review the document package before any materials are shared externally.
- [Scott Warner] Withhold any documents I determine should not be produced.
- [Scott Warner] If additional production is requested or ordered by the court, set up follow-up calls and manage discussion of what can be shared.
- [Scott Warner] Ensure any external interpretation of German or EU data-sharing requirements is validated by qualified European counsel rather than handled informally.
4. Relevant Timelines
- Immediate / next step: Norbert to send the file-share link and separate email with questions.
- Near term: I will review the files before any external sharing occurs.
- As needed: If the court orders additional disclosure, I will coordinate follow-up discussions and phased sharing.
5. Additional Notes
- The confidential ZIP includes investigation-related analysis and annotated Excel files, so it requires tighter control than the general document set.
- Norbert remains unclear on certain facts described in the indictment and intends to raise those questions separately.
- A major risk theme is compliance with German and EU data protection requirements, especially where documents contain personal names or other personal data.
- Most of the source material is in German, but translation is not an obligation on our side under the current rules.
- The overall approach is to minimize disclosure, review carefully before production, and only expand sharing when formally required.
